1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the RecoverFlow website and service (the "Service"), operated by RecoverFlow ("RecoverFlow," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of the Service
RecoverFlow is a software tool that helps businesses recover failed Stripe payments by automatically notifying customers through email, SMS, and optional WhatsApp, and by directing them to secure payment-update links. The Service connects to third-party services including Stripe, Twilio, Resend, and WhatsApp that you authorize us to access on your behalf.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that you have full authority to connect the accounts and data you provide.
4. Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for the messages you send, the content of your recovery templates, and ensuring your use of the Service complies with all applicable laws, including anti-spam regulations such as CAN-SPAM and the GDPR.
5. Fees, Subscriptions, and Payment
Fees for the Service are described on our pricing page and are processed by our payment provider, Paddle. All payments are non-refundable except as described in our Refund Policy. We may change fees or introduce new fees from time to time; changes to subscription pricing will take effect at the start of your next billing period.
6. Acceptable Use
You agree not to use the Service to: (a) send unsolicited or unauthorized messages; (b) violate any law or regulation; (c) infringe the rights of any third party; (d) attempt to gain unauthorized access to the Service or its systems; (e) interfere with the proper operation of the Service; or (f) resell or sublicense the Service without our prior written consent.
7. Data and Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data. You retain all rights to your own data. We process data on your behalf as necessary to provide the Service.
8. Third-Party Services
The Service integrates with third-party services such as Stripe, Twilio, Resend, WhatsApp, and Neon. We are not responsible for the availability, accuracy, or performance of these third-party services. Your use of them is subject to their respective terms and policies.
9. Intellectual Property
The Service, including its software, design, text, graphics, and trademarks, is owned by RecoverFlow and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written permission.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that it will result in the recovery of any specific amount of revenue.
11. Limitation of Liability
To the maximum extent permitted by law, RecoverFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amounts you paid us in the twelve (12) months preceding the claim.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including warranties disclaimers and limitations of liability.
13. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
